Terms of Service
Please read these terms carefully before using Company360's services. By placing an order or using our platform, you agree to be bound by these terms.
Last updated: 1 January 2026
1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the website located at www.company360.in (the "Site") and the professional services offered by Company360 (a brand name used by its operating entity, hereinafter "Company360", "we", "us", or "our"). By accessing the Site, creating an account, or placing an order for any service, you ("Client", "you") unconditionally accept and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to any of these Terms, you must immediately discontinue use of the Site and must not purchase or use any service. We reserve the right to modify these Terms at any time; the updated Terms will be effective from the date of posting on the Site. Your continued use of our services after any modification constitutes acceptance of the revised Terms.
2. Services
Company360 provides intellectual property registration services (including trademark, patent, copyright, and design registration), legal drafting services (contracts, notices, and opinions), and associated advisory services in India. All services are provided by or under the supervision of qualified advocates and registered IP practitioners.
Our services are limited to legal process facilitation, drafting, filing, and prosecution before the relevant intellectual property offices and courts in India. We do not guarantee the outcome of any application or proceeding, as final decisions rest with the relevant government authority. Outcomes depend on the specific facts of each matter, applicable law, and the policy of the relevant authority.
Company360 does not provide legal advice in matters outside the scope of IP and related commercial law, and our services do not create an advocate-client relationship beyond the scope of the specific service engaged.
3. Payment & Fees
All fees are payable in Indian Rupees (INR). Professional fees quoted on the Site are exclusive of Goods and Services Tax (GST), which will be charged at the applicable rate. Government fees, official filing charges, translation costs, and third-party charges are charged separately, at actuals, and are non-negotiable.
Payment is due at the time of placing an order. We do not commence work on any service until full payment (professional fee and any upfront government fee) has been received and confirmed. Milestone-based payments may be agreed for large projects; such agreements must be confirmed in writing.
We accept payment via UPI, NEFT/RTGS, credit/debit card, and other methods displayed on our payment page. Receipts and GST invoices are issued for all payments within 2 business days of receipt.
4. Government Fees
Government fees are those charged directly by the Indian Patent Office, Trade Marks Registry, Copyright Office, Design Office, or any other statutory authority in connection with your application. These fees are collected by us on your behalf and paid to the relevant authority.
Government fees are subject to revision by the relevant authority at any time. Where fees are revised after your order has been placed but before filing, the difference will be charged to you. We will notify you of any such revision before proceeding.
Government fees paid to any statutory authority are non-refundable under any circumstances. This includes fees paid in connection with applications that are rejected, withdrawn, or abandoned after filing.
5. Refunds
Professional fees may be refunded in limited circumstances as described in our Refund Policy (published separately on the Site). In general:
- If you cancel within 24 hours of payment and we have not commenced work, a full refund of the professional fee will be issued.
- Once work has commenced (including document review, prior art search, drafting, or filing preparation), no refund of professional fees is available.
- Once an application has been filed with any statutory authority, no refund of professional fees or government fees is available.
- If Company360 is unable to provide the agreed service due to its own error, we will offer a re-do of the service or a refund of professional fees at our discretion.
Government fees paid to statutory authorities are strictly non-refundable and are not within our control to refund.
6. Intellectual Property Ownership
All intellectual property in and to the services we deliver on your behalf — registered trademarks, filed patent applications, copyright works, or registered designs — belongs to you (or the entity you authorise us to file for). Company360 does not claim any ownership right in the IP we register or file on your behalf.
All intellectual property in our own website, content, tools, templates, and processes belongs exclusively to Company360. You may not reproduce, resell, or distribute any of our proprietary materials without our prior written consent.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Company360's aggregate liability to you for any claim arising out of or in connection with our services shall not exceed the professional fee paid by you for the specific service that gave rise to the claim.
We are not liable for: (a) any rejection, cancellation, or opposition of any application by a statutory authority; (b) any loss of profit, revenue, or business; (c) any indirect, incidental, or consequential loss; or (d) delays caused by government authorities, court systems, or events beyond our control.
Our role is to exercise professional skill and care in preparing and filing your application. We cannot guarantee the decisions of independent government authorities, and no warranty is given that any application will result in registration or grant.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms or the services provided by Company360 shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
Before initiating any formal proceedings, you agree to notify us in writing of the dispute and allow 30 days for good-faith resolution discussions. We are committed to resolving genuine disputes promptly and fairly.
9. Amendments
We may update these Terms from time to time to reflect changes in our services, applicable law, or business practices. Updated Terms will be posted on this page with a revised "Last updated" date. For material changes, we will notify registered clients by email. Your continued use of our services after the effective date of revised Terms constitutes your acceptance of those Terms.
